Our banking and finance
attorneys have many years of
experience advising regional
and national financial
institutions, as well as other
lending organizations, in
virtually all aspects of their
business and credit activities.
Our diverse client base has
allowed us to develop expertise in a wide range of transactional,
regulatory and operational matters.
Higier Allen & Lautin attorneys regularly represent and counsel lenders in
the areas of acquisition financing, asset-based lending,
commercial and consumer lending, letter of credit facilities,
mortgage warehouse lending, multiple creditor facilities (including
participations), real estate lending (including acquisition,
construction and development financing), SBA lending, factoring
arrangements, manufactured housing financing, workouts,
restructurings, foreclosures and liquidations. We have extensive
experience creating, perfecting and foreclosing liens and security
interests in both common and unusual types of collateral. In
addition, the firm has recently begun to provide residential
mortgage loan documentation on a low-cost volume basis, and
has established an affiliate escrow company to serve as an escrow
agency to enable our bank clients to act as a third party escrow to
their customers.
The Firm strives to provide responsive, cost-efficient services to
our lenders. We know that both turnaround time and cost
efficiency are important to our lenders. For each lending
transaction, an attorney of appropriate experience and expertise is
assigned to handle the credit. Nonetheless, our transaction
attorneys are trained to utilize the accumulated knowledge of the
other lawyers within the Firm, including our bankruptcy, real
estate, corporate and litigation attorneys, to successfully
structure, negotiate, document and workout transactions.
In addition to credit activities, Higier Allen & Lautin attorneys are
experienced with various regulatory issues, such as the
development of new products and services, compliance with
federal and state regulations, the formation and operation of
subsidiaries, officer liability, executive compensation, insurance
and other financial services. We also counsel our clients on a
wide array of bank operations issues.
